ملخص البحث
يهدف البحث إلى بيان العلاقة بين فن الأشباه والنظائر وبين النظريات الفقهية، وهل يغني أحدهما عن الآخر؟، وقد استعمل الباحث المنهج الوصفي والمقارن في حل إشكالية البحث.
وقد توصل البحث إلى أن فن الأشباه والنظائر هو الفن الذي يعني بجمع الفروع التي يشبه بعضها بعضا في الصورة سواء كانت متحدة في الحكم أم مختلفة فيه، ويبين أصولها وفروعها وفروقها وبناء بعضها على بعض، وتدرك به أحكام الحوادث غير المسطورة.
وأما النظريات الفقهية فلم تتفق آراء المعاصرين في مفهومها، وتوصل البحث أنها تنحصر في : القواعد الفقهية، ونظام تشريعي، وأسلوب في التأليف الفقهي المعاصر.
وتوصل البحث إلى أن النظرية الفقهية بسائر اتجاهاتها معروفة ومقررة من حيث المضمون لدى فقهائنا الأقدمين رحمهم الله، ومضمونها وأهدافها يدرك من خلال فن الأشباه والنظائر، ويظهر ذلك جليا في القواعد والضوابط الفقهية التي تجمعها وحدة موضوعية واحدة، وأن القواعد الفقهية المقننة بها الغنية عن إيجاد نظريات فقهية تمثل مبادئ تشريعية ملزمة.
وأوصى الباحث بجمع القواعد التي تجمعها وحدة موضوعية واحدة ورد الفروع إليها في كافة فروع المعرفة الفقهية والقانونية، وتأصيل ارتباط بعضها ببعض ؛ لتكون مرجعا لمن يريد معرفة الاتجاهات العامة والكلية للفقه الإسلامي.

Abstract
This study investigates the relationship between ( analogies and isotopes ) and the jurisprudence theories. The researcher used the descriptive comparative methodology.
The study results showed that this art is concerned with all the branches that are similar to each other whether they are united or different in the legal ruling.It clarified their principles and differences , the way of building on each other and its role in perceiving unrecorded events.
The researcher revealed that they are based on three pillars: rules of jurisprudence, legislative laws and the style of contemporary jurisprudence authoring.
The researcher concluded that the jurisprudence theory with its directions is already known and confirmed by the old jurists, and its concept and objectives can be recognized by the art of analogies and isotopes.This is shown clearly in the jurisprudence rules and regulations which are collected in one thematic unit. He also concluded that the jurisprudence rules represent binding legislative principles.
The researcher recommended to collect the rules of one thematic unit accompanying with the branches in all the jurisprudence and legal knowledge branches and rooting them to build a source of knowing the general and overall directions of Islamic jurisprudence.
