ملخص الدراسة

 تناولت الدراسة توظيف القواعد الفقهية والاستفادة منها بنظرة كلية عامة، واستخدم الباحث المنهج الاستقرائي الوصفي، وتهدف الدراسة إلى وضوح في تحديد مجالات الاستفادة من القواعد الفقهية والتذكير بقضية توظيفها، وقد توصلت الدراسة إلى نتائج منها: مجال عمل القواعد الفقهية واسع جدًا، وهناك نوع من عدم الوضوح في تحديد توظيف القواعد كفرع مستقل، من مجالات توظيف القواعد الفقهية الأدلة والدعوة ومعرفة مظان المسائل والمساعدة على الحفظ والاستفادة في الفتوى والقضاء، وخرجت الدراسة بتوصيات هي: طَرْق موضوع توظيف القواعد الفقهية واستخداماتها على المجالات المختلفة في الرسائل العلمية والبحوث، وإيجاد دراسات جادة لقضية الاستدلال بالقواعد الفقهية والتفريع عليها.

The study dealt with the use of jurisprudence rules and benefiting from them with a general college view. The researcher used the descriptive inductive approach.

The study aims at clarity in determining the areas of benefiting from the juristic rules and recalling the issue of their employment. The study reached results, including:

The field of jurisprudence work is very broad, there is a kind of lack of clarity in determining the employment of the rules as an independent branch, Among the areas of employment of jurisprudence rules are evidence and advocacy, knowledge of issues, and assistance in preserving and benefiting from the fatwa and the judiciary,

The study came out with recommendations:

Methods of the subject of employing juristic rules and their uses on various fields in scientific theses and research, Finding serious studies of the issue of reasoning through jurisprudence and sub-jurisprudence.
